Welcome! We’re delighted you’re coming on tour with us for an unforgettable immersive experience in Cyprus, Greece, or Italy. Below you will find all the Terms and Conditions that apply to your upcoming trip.

1. About Our Contract

    1. A contract is formed between you and TM2 Europe Pty Ltd (TM2E/us/we), trading as Take Me To Europe Tours (ACN 677 677 815) when TM2E accepts your booking and we have received your deposit, whichever comes later. 

    1. The contract is agreed to have been made in the State of Victoria, Australia, and is governed by the laws of that State.  Any litigation arising out of the contract or the tour is also governed by the laws of the State of Victoria, including requirements for mediation. 

    1. If you are a habitual resident of a country in the European Economic Community (EU) and despite this clause it is found that EU law and the Law of Cyprus, Italy, or Greece apply to the contract, then these terms and conditions are amended to the extent needed to comply with those laws, in particular the law and regulations in that country which implement the EU Package Travel Directive.

    1. These terms and conditions, together with any special conditions we agree, constitute the entire contract between us and supersede all previous oral or written communications, representations, or agreements between you and TM2E.

    1. The boutique nature of our itineraries means that tours are subject to minor changes, updates, and additions as we come closer to departure.  We make these changes to enhance your tour experience and by contracting with us you understand that this may happen.  More fundamental kinds of changes are dealt with below in these Terms & Conditions.

2. Minimum Age of Participants

    1. Our tours are immersive cultural experiences that involve the consumption of wine. For this reason, we do not accept tour participants under the age of 18 for our Greek tours, under the age of 17 for our Cyprus tours, and under the age of 16 for our Italian tours, so that we comply with the laws of those countries.

    1. We do want this to be a memorable family experience for you, so if you have children 16 – 18 years of age who would love to join us on tour, please get in touch and we’ll see what we can arrange.

    1. For private tours, we do not have a minimum age.

3. Payment Obligations

    1. For this contract to have come into effect, you will have paid a deposit of 10% of the total tour price calculated as at the date of the contract.

    1. The payment instalment of 20% must be received by us no later than 120 days before the commencement of the tour.

    1. The remaining 70% must be received by us no later than 90 days before the commencement of the tour.

    1. If you do not pay the remaining 70% within the required time, we reserve the right to cancel your booking, in which case clause 5(c) below applies.

    1. If you are booking within 90 days before the commencement of the tour, the full 100% must be received by us before our contract comes into effect.

    1. Payments are due in the currency quoted on our web page for your tour. 

    1. We do not provide refunds if you choose not to participate in all the activities of your tour, such as meals, transport charges, or other services.

4. Surcharges

    1. As is standard practice in the travel industry, which is subject to many fluctuations in conditions, we have the right to increase the price of your tour up to 45 days before departure if the cost to us has increased because of unfavorable exchange rates, transportation costs, local operator costs, taxation changes or government action.

    1. We will absorb the above aggregate increase in costs up to 5% of the tour price.  We will pass on to you any remaining increases as a surcharge, but if this results in a surcharge of 10% or more of the original tour price, you may cancel the booking within 14 days of notification of the surcharge and we will make a full refund to you.

    1. In addition to the above conditions, a 2% surcharge will be applied to any payments you make by credit card. This credit card surcharge is made clear on the booking page. There are no surcharges for bank transfers.

5. Cancellation By Us

    1. We have the right to cancel your booking, in accordance with the relevant sub-clauses below, if:
        • The minimum number of tour participants is not reached

        • You do not make payments required under this agreement

        • A Force Majeure event occurs.

    1. The minimum number of tour participants, and the date by which the minimum number must be reached, will have been stated on the relevant page of our website for your tour.  If we do not reach that number, we have the right to cancel the tour by notifying you within 7 days after the relevant date, in which case we will repay all the moneys received from you within a further 7 days.

    1. If you do not pay the balance of the tour price and any surcharges within the time periods applicable to your contract, we have the right to keep all payments made up until then.  In practical terms, this normally means we forfeit your deposit.

    1. If a force majeure event occurs at any time before the end of the tour we have the right, without liability or obligation, to cancel the tour or vary the remaining activities, depending on what has happened, bearing in mind that your safety and security are our paramount considerations.  If the tour has not begun and we cannot make reasonable alternative arrangements of equal value, we will cancel the tour and return all moneys received from you.  If the tour is already under way and we cannot make reasonable alternative arrangements of equal value, we will cancel the remainder of the tour and provide a pro rata refund.

    1. A force majeure event includes major unforeseen circumstances beyond our reasonable control, such as (but not limited to) acts of nature, terrorist activities, insurrection, flood, earthquake, tempest, fire, accident, war or threat of war, civil disturbance, labour strikes, pandemic or other widespread sickness, quarantine and government intervention.

6. Cancellation By You

    1. If you cancel your tour by notifying us in writing and there are at least 120 days before the start of the tour we will return your 30% deposit minus US$250, to cover finance fees and other non-refundable costs associated with your booking.

    1. If you cancel your tour by notifying us in writing and there are at least 61 days before the start of the tour, we will refund half of your deposit.

    1. If you cancel your trip by notifying us in writing and there are 60 or less days until the start of the tour, we will retain all of your deposit.

    1. If you fail to attend the tour, we will treat this as a cancellation by you and retain all money you have paid.

    1. If you begin the tour but fail to complete it, we will treat this as a cancellation by you from that point onwards and retain all money you have paid.

7. Unforseen Circumstances

    1. We understand that events happen in people’s lives and that there are risks inherent in making a booking several months ahead.  For this reason, we strongly advise you to take out travel insurance covering all risks relevant to you as we cannot accept liability for your inability to attend and complete the tour.

    1. We advise you not to book nonrefundable flights until we have confirmed the tour is going ahead.

    1. If through unforeseen circumstances, you arrive late for a tour or need to leave before its completion, we will do our best to amend bookings associated with you (such as travel, meals or accommodation) and to the extent we can reduce our costs we will pass the reduction on to you by way of refund. This is not, however, a substitute for an appropriate level of travel insurance cover.

    1. If you cannot attend the tour but would like to substitute another person, you should notify us as early as possible.  We are not under an obligation to accept them, and so our rights of cancellation still apply, but we will act reasonably and responsibly.  If we do accept them, then both of you are jointly and severally liable for any remaining payments.

    1. We will not accept the substitution of another person once the tour has commenced.

9. Other Information You Should Be Aware Of

    1. Your passport should be valid for at least 6 months from the date you will be returning home.  Some countries only require 3 months post-return validity, but 6 months is normal and it is your responsibility to ensure sufficient validity.

    1. From 2025, the EU is incrementally introducing a new Entry Exit System (EES) and then the Electronic Travel Information and Authorisation System (ETIAS) for non-EU travelers even though they are from visa-exempt countries.  This applies to all three of the countries where we provide tours.  The official EU site is at ETIAS – European Union (europa.eu) and we advise you to be familiar with the requirements.  We will endeavor to provide up-to-date information on the Take Me To Europe Tours website, but we cannot take responsibility for this.  You should also check the government website for the relevant country of your tour as it applies to you and your home country:

    1. We do not take any responsibility if you are denied entry to the country and we will not provide refunds in this event.

    1. We recommend that you be fully vaccinated for all normal infectious diseases, such as influenza and Covid-19.

    1. You must comply with any local laws in respect of vaccination, face-coverings, distancing, etc, as will your tour leader and tour guides. 

    1. If you feel unwell, please let your tour leader know and we will assist you with accessing treatment options including with English-speaking medical specialists.

    1. Because refunds are made available only per the policy outlined above, and we are unable to make exceptions for any reason, including weather, injury/illness, or personal emergencies, we strongly recommend all guests take out a comprehensive travel insurance policy to compensate you in case of unexpected cancelations. Insurance should cover you for travel cancellations, medical emergencies in the country in which the tour takes place, and international evacuation coverage.

    1. By joining our trips you agree to notify us of any dietary or restricted mobility requirements before paying your deposit so we can confirm that your needs can be met within the limitations of the itinerary, the destination, and the trip style.

10. Waiver

    1. You assume the risk involved in foreign travel and in participating in the activities of our tours.  We assume you have the necessary physical ability and other capabilities to participate in them unless you and TM2E have agreed to the contrary in a special condition.

    1. To the extent permitted by the law governing this contract, you agree to release TM2E from all liability other than that which is stated in these Terms & Conditions.  We will ask you to sign a Waiver of Responsibility form to this effect before you begin the tour, to ensure that you understand you need to exercise judgment and reasonable care at all times for your safety and the safety of others.

11. Authority of Tour Leaders

    1. TM2E tours are led by experienced, bilingual tour leaders.  Their decision is final on all matters likely to affect the safety or well-being of any guest or staff member. 

    1. If you fail to comply with a decision made by a tour leader or otherwise behave in a way that might affect the safety, well-being, or enjoyment of staff or other guests, we may require you to leave the tour, without a refund.
